Opnico SafeSurf is software, designed and built by Opnico Ltd, published by Opnico Ltd (together called "Company", "We", "Our", "us"). These Terms of service (shortly called "Terms" in this document) govern your use of Opnico SafeSurf software products (iOS and Android applications) and their related websites located at www.opico.com and www.opnico.net (everything called "Service"). You acknowledge that you have read and understood Terms, and agree to be bound by them. These Terms apply to all visitors, users, and others who wish to access or use this Service. If you do not agree (or cannot comply) with Terms, then you should not use this Service.
In addition to the terms defined in the Introduction above, the following capitalized terms shall have the specific meanings set forth below throughout these Terms:
"Account" refers to the unique profile created for and assigned to a User upon mandatory authentication via Google Sign-In, which is required to access and utilize the Service.
"App" or "Software" refers specifically to the Opnico SafeSurf mobile applications available on the Android and iOS operating systems, including all underlying codes, algorithms, updates, upgrades, and modifications thereto.
"Scan", "Check", or "Lookup"refers to a single, automated instance wherein the App analyzes a potential threat (such as a network request or screen content element) against the Company's threat intelligence infrastructure.
"Device" refers to the legally permitted digital device owned or controlled by the User upon which the App is installed.
"Free Plan" refers to the limited, non-paid access tier of the Service, which currently restricts a User to a lifetime maximum of 2000 Checks.
"Subscription" refers to a fee-based tier of the Service (e.g., weekly or monthly paid plans) that grants extended access and removes the Free Plan's absolute Lookup limits, subject strictly to the technical rate limits defined in these Terms.
"Threat" refers to suspected phishing attempts, malicious links, unwanted software, or social engineering content identified by the App's local monitoring and hash-based verification architecture.
"User", "You", or "Your" refers to any individual of legal majority who downloads, installs, registers for, accesses, or otherwise interacts with the Service.

By downloading, installing, or using the Service, these Terms automatically apply to You in their entirety. You agree to use the Service exclusively for legitimate, personal security purposes and expressly agree not to utilize the Service for any illegal, unauthorized, or prohibited activities.
Eligibility and age requirements: The Service is not targeted towards, nor intended for use by, anyone under the age of 13 (or 16 in certain jurisdictions within the EU/EEA). By downloading, accessing, or using the Service, You represent and warrant that You are at least 18 years of age or the age of legal majority in Your jurisdiction of residence. If You are between the ages of 13 and the age of legal majority, You represent and warrant that You have obtained valid, verifiable consent from parent or legal guardian to use the Service and agree to these Terms. If We become aware that We have collected personal information from a child under the age of 13 (or 16 in certain jurisdictions within the EU/EEA), or from a minor without verifiable parental consent where required, We will take immediate steps to delete such information and terminate the associated Account.
Single device policy & session management: To ensure Account security and prevent the unauthorized sharing of Subscription benefits, the Service enforces a strict single-device policy per Account.
Single active session: Your Account is permitted to be active on only one (1) Device at any given time.
Automatic displacement: If You sign in to Your Account from a other Device while a session is already active on another, the Service will automatically sign You out from the current Device.
Security rationale: This mechanism is a critical security feature designed to protect Your threat intelligence quota and ensure that Your unique security profile is not being utilized by unauthorized parties.
Subscription portability: While You are limited to one active session at a time, You may switch between Devices (e.g., from an old iOS device to a new Android device) by simply signing in on the new Device; however, the background monitoring and other features on the displaced Device will cease to function until You sign back in on that specific hardware.
Fair use and technical rate limits: While certain Subscription tiers may advertise "Unlimited", all usage of the Service is subject to technical rate limits and a fair use policy designed to prevent API (Application Programming Interface) abuse, bot activity, and infrastructure overload. Opnico Ltd reserves the right to throttle, pause, or terminate Account access if Your volume of requests drastically exceeds the typical usage of an individual human user, or if Your usage poses a risk to the stability and performance of Our threat intelligence infrastructure. Opnico Ltd also reserves the right, in its sole and absolute discretion, to refuse service, limit access, or terminate your Account at any time, without notice, for any reason—including, but not limited to, a breach of these Terms, suspected fraudulent activity, or behavior that we deem harmful to the Service.
Furthermore, We reserve the unilateral right to make any modifications to the Service at any time. This includes, without limitation:
Feature modification: Changing, suspending, or discontinuing any specific functionality, feature, or part of the App.
Service availability: Terminating or suspending the Service entirely, either temporarily or permanently.
Usage constraints: Imposing additional rules, technical limits, or "Fair Use" policies on the use of the Service to maintain system integrity.
You acknowledge and agree that these modifications may be performed without prior notice and without liability to You or any third party. It is your sole responsibility to review this page and these Terms regularly to stay informed of any updates. Your continued use of the Service following the posting of any changes constitutes your irrevocable and binding acceptance of such modifications. If at any time You do not agree to the current Terms, You must immediately cease all use of the Service and delete the App from Your Device.
Global access: The Service is made available to Users worldwide. However, access to Service or certain features, content, or functionality may be restricted in specific regions to comply with applicable laws, regulations, sanctions, or export control requirements of the European Union and other relevant jurisdictions. Users are responsible for ensuring that their use of the Service is lawful in their country of residence.
Governing law: These Terms, and any non-contractual obligations arising out of or in connection with them, shall be governed by and construed in accordance with the laws of a Member State of the European Union in which the Service provider is established, without regard to its conflict of law principles. Where applicable, mandatory consumer protection laws of the User's country of residence shall remain unaffected.
Disputes: Any dispute, controversy, or claim arising out of or relating to the Service or these Terms, including their validity, interpretation, performance, or termination, shall be subject to the exclusive jurisdiction of the competent courts of the EU Member State in which the Service provider is established. If the User is a consumer residing in the European Union, they may also bring proceedings in the courts of their country of residence in accordance with applicable consumer protection laws. Nothing in these Terms limits any rights available under EU consumer protection regulations.

Intellectual property: The "Opnico" brand and logo are registered as trademark within the European Union Intellectual Property Office (EUIPO), providing protected status across all EU Member States. All rights, title, and interest in and to the Service, including but not limited to its source code, object code, design, user interface, graphics, trademarks, logos, and related documentation, are owned by or licensed to the Company and are protected by applicable intellectual property laws. Except as expressly permitted under these Terms, no part of the Service may be copied, modified, distributed, sold, leased, sublicensed, reverse engineered, or otherwise exploited without prior written consent. All rights, not expressly granted to the User, are reserved by the Company.
Feedback and submissions: We welcome Your feedback, comments, bug reports, and suggestions for improvements to the Service. You acknowledge and agree that any feedback You provide is strictly voluntary. By submitting feedback, You grant Opnico Ltd a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license to use, reproduce, modify, publish, and distribute the feedback for any purpose, commercial or otherwise, without any compensation or credit to You.
The Service, App, and underlying technology are subject to export control and economic sanctions laws of the European Union, the United States (including the U.S. Export Administration Regulations and the U.S. Department of the Treasury's Office of Foreign Assets Control), and other applicable jurisdictions. By downloading or using the Service, You represent and warrant that:
You are NOT located in, under the control of, or a national or resident of any country or territory subject to a comprehensive U.S. or EU government embargo.
You are NOT listed on any U.S., EU, or applicable government list of prohibited or restricted parties (including, but not limited to, the U.S. Specially Designated Nationals List).
You agree to comply strictly with all applicable export laws and assume sole responsibility for ensuring your use of the Service does not violate these regulations.
To operate the App efficiently while minimizing data exposure, We limit the information We collect to the following categories:
Account information: When You authenticate via Google Sign-In, We receive basic profile information such as Your name and email address from Google. Authentication is handled by Google in accordance with its own privacy practices.
Usage metrics: We collect limited usage data in the form of aggregate numerical values, such as the total number of security checks performed and the remaining lookup quota associated with Your Account.
Device context (processed locally): The App analyzes screen content or network requests locally on Your Device for the purpose of identifying potential threats. This information is processed on-device and is not transmitted to Our servers.
Hash prefixes: The App generates SHA-256 hashes of certain data locally on Your Device for further detection of potential threats. Where necessary, only partial hash values (such as prefixes) are transmitted to Our servers to check whether the data matches known entries in Our threat intelligence databases. These hashes are one-way representations of data and are intended to minimize the risk that the original data can be derived from them.
Privacy of that information: Your privacy is governed by Our Privacy policies, which is incorporated into these Terms by reference. By accessing or using the Service, You acknowledge that You have read and understood the Privacy policies. If You are a resident of California or another U.S. jurisdiction with applicable privacy laws, You may have certain rights regarding Your personal information, including the right to know, access, correct, or delete Your personal information, as well as the right to opt out of the sale or sharing of personal information and to limit the use of sensitive personal information, where applicable. Details on how to exercise these rights are set forth in the Privacy policies. Opnico Ltd does not sell personal information as defined under applicable law. If You are located in the European Economic Area, United Kingdom, or similar jurisdictions, You may have additional rights under applicable data protection laws, including the right to access, rectify, erase, restrict, or object to the processing of Your personal data, and the right to data portability. Further information, including the legal bases for processing and applicable data retention periods, is provided in the Privacy policies.
We DO NOT intentionally collect, log, or store browsing history, raw URLs, passwords, messages, or any other personal on-screen content.
Content moderation: If You encounter any content within our Service that You find offensive, inaccurate, or inappropriate, You are encouraged to notify Us at opnico.com@gmail.com. While We will review all reported concerns and consider requests for content modification or removal, the Company is under no legal obligation to do so, nor are We obligated to provide a direct response or justification regarding Our decision.
Accuracy and availability - while We strive for excellence, the Company does NOT warrant or guarantee:
That all information, threat intelligence, or materials provided through the Service are correct, accurate, complete, or error-free.
That the Service, or any specific materials within it, will remain available at all times or without interruption.
That the Service or its content will be continuously updated or maintained to reflect the most current cybersecurity developments.
Purchases: If You wish to purchase a Subscription available through Service, You may be asked to supply certain information relevant to Your purchase including, but not limited to, Your credit or debit card number, the expiration date of Your card, Your billing address, and Your shipping information. Purchases may also be completed via carrier billing or other supported payment methods depending on Your region and platform.
When purchasing, You represent and warrant that:
You have the legal right to use any card(s) or other payment method(s) in connection with any purchase.
The information You supply to Us is true, correct, and complete.
Free Plan and paid subscriptions: The Service is offered under a Free Plan with defined Lookup limitations. To exceed these limitations, Users may opt to purchase a Subscription. By selecting a Subscription, You agree to pay all applicable fees and taxes associated with chosen plan.
App store billing: All Subscriptions, in-app purchases, and related billing processes are handled entirely by the respective platform operators (Apple App Store for iOS or Google Play Store for Android). Opnico Ltd does not directly process or store payment card data or related information. Receipts and invoices are also issued automatically by Apple (iOS) or Google (Android).
Auto-renewal: Unless otherwise stated at the time of purchase, Subscriptions are billed on a recurring basis (e.g., weekly, monthly) and will automatically renew at the end of each billing cycle unless You cancel auto-renewal at least 24 hours before the end of the current period.
Cancellation: You may cancel Your Subscription at any time. Cancellation can be performed through Your Apple ID or Google Play Account settings. Deleting the App or Your account does NOT automatically cancel Your active Subscription. Upon cancellation, You will retain access to the Subscription features until the end of Your current paid billing period.
Statutory right of withdrawal (EU & EEA Consumers): If You are a consumer residing in the European Union or the European Economic Area (EEA), You generally have a statutory right to withdraw from a contract for digital content within 14 days of its conclusion, without providing any reason.
Waiver of withdrawal right (refunds): By downloading the App and accessing the Service, you expressly consent to the immediate delivery and execution of the digital content. You acknowledge and agree that by providing this consent, you irrevocably waive your statutory 14-day right of withdrawal.
Please note that because the Service is fulfilled through third-party platforms:
Any requests for refunds must be directed to the respective platform operator (Apple or Google).
Refund eligibility is governed exclusively by their respective refund policies and terms of service.
We reserve the right to refuse or cancel your order at any time for reasons including but not limited to:
Service availability or technical errors.
Errors in the description or price of the subscription.
Errors in Your order.
Suspicion of fraud or an unauthorized or illegal transaction.
Note: We will never charge you for the App or its services without your request, permission, and in-product confirmation. We do not collect or store any kind of sensitive payment information or data.
General integration: The Service utilizes third-party providers for infrastructure, analytics, and monetization. While these providers maintain their own independent terms and privacy policies, their services are integrated into Our software to provide core functionality. By using the Service, You acknowledge and agree to be bound by the terms of these third parties.

Platform services: Apple App Store Services (iOS) and Google Play Services (Android).
Infrastructure and database: Firebase (incl. Google Cloud Firestore) and MongoDB Atlas.
Analytics and performance: Google Analytics for Firebase and Firebase Crashlytics.
Distribution and testing: Apple TestFlight and Firebase App Distribution.
Platform-specific acknowledgments:
Apple (iOS): You acknowledge that these Terms are between You and Opnico Ltd only, and not with Apple, Inc. We are solely responsible for the application. Apple has no obligation to provide maintenance or support services for the application.
Google (Android): Your use of the Software is subject to the Google Play Terms of Service and any associated policies regarding in-app purchases and software distribution.
External links and policies: These third-party services may declare their own terms of use and policies. We recommend reviewing them, as they govern how Your data is handled by those specific entities. You can find links to their respective policies on their official websites.
Security label: We implement industry-standard measures to protect the integrity of the Software. However, the security of Your data also depends on the security of the Device You use to access the Software.
Prohibited modifications:
It is Your responsibility to maintain the security of Your Device.
You are strictly prohibited from using the Software on any Device where the operating system has been modified outside of the manufacturer's official specifications. This includes, but is not limited to:
"Jailbreaking" (iOS);
"Rooting" (Android);
Escalating system privileges or flashing unauthorized firmware.
Assumption of risk: Modifying Your Device's operating system compromises built-in security features, making Your Device vulnerable to malware, unauthorized access, and data loss.
We are NOT responsible for any security breaches, service failures, or data loss resulting from the use of the Software on a compromised or "modified" Device.
User responsibility (to ensure the best experience and digital safety):
Always download and install the Software from official stores (Apple App Store | Google Play Store).
Do not sideload the Software via third-party ".ipa" or ".apk" files.
Keep your operating system and the Software updated to the latest versions.
Disclaimer: We do NOT support, and are not responsible for, any security breaches or performance issues resulting from the use of unofficial, "modded," or pirated versions of the Software.
Keep in mind: Protecting your device is crucial for protecting your personal information. Stay safe!
You are granted a limited, non-exclusive, non-transferable, and revocable license to use the Service strictly in accordance with these Terms. You agree that You will NOT:
Reverse engineer or decompile: Attempt to reverse engineer, decompile, disassemble, or derive the source code, underlying algorithms, or threat-intelligence architecture of the Software.
Abuse the infrastructure: Use the Service in any manner that could disable, overburden, damage, or impair Our servers, networks, or the performance of the Service. This includes bypassing or attempting to bypass the technical rate limits or Lookup quotas defined in Your plan.
Commercial exploitation: Sell, lease, sublicense, distribute, or commercially exploit the Service, its threat data, or any API (Application Programming Interface) access without express written permission from the Company.
Malicious use: Use the Service to develop a competing product, analyze malware for malicious purposes, or engage in any activity that violates local, state, national, or international law.
The Service, including all threat detection capabilities, is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.
No guarantee of absolute security: While Opnico SafeSurf utilizes advanced algorithms and threat intelligence, the cybersecurity landscape is constantly evolving. Opnico Ltd expressly disclaims any warranty that the Service will detect, block, or prevent 100% of all Threats, phishing attempts, malware, or unwanted software. The App is designed as a supplementary security tool and should not be relied upon as the sole measure of protection for Your Device or personal data.
No warranty of uptime: We do not warrant that the Service will be uninterrupted, error-free, entirely secure, or that any defects or errors will be corrected in a timely manner.
To the maximum extent permitted by applicable law, in no event shall Opnico Ltd, its directors, employees, partners, agents, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages. This includes, without limitation, loss of profits, data, use, goodwill, or other intangible losses resulting from:
Your access to, use of, or inability to access or use the Service.
Any unauthorized access to or alteration of Your transmissions or data.
Any malware, phishing success, or system failure that occurs despite Your use of the App.
Any conduct or content of any third party utilizing the Service.
Liability cap (if applicable): In no event shall the total liability of Opnico Ltd to You for all damages, losses, and causes of action exceed the total amount paid by You to the Company (via platform providers) for the Service during the twelve (12) months strictly preceding the claim.
Don't forget: Opnico SafeSurf is designed to be a strong, additional layer of security for your device, but no app is perfect. Cyber threats evolve hourly, which means we cannot promise 100% protection against all online dangers. By using this app, you understand that SafeSurf acts as an added safeguard, and Opnico Ltd cannot be held legally responsible for data loss, breaches, or damages if a threat bypasses our systems.
Service requirements and permissions: To perform the basic functions effectively on the Android platform, the Service requires specific system-level permission - manually enabling Opnico SafeSurf accessibility service.
Opnico SafeSurf accessibility service: You acknowledge that the App's real-time threat detection features depend on the activation of the Opnico SafeSurf accessibility service - service that is based on Android Accessibility Service. This permission allows the App to analyze screen content and detect malicious websites (URLs).
Functionality limitation: If You choose not to grant these permissions or subsequently revoke them, the App will not be able to provide You security (real-time protection), which is the core functionality of the Service.
No interference: App does not use these permissions to alter user settings, interfere with user interface controls, or monitor private user data for any purpose other than providing security (real-time protection) against Threats.
Service availability and system limitations: The effectiveness of the Service is subject to the limitations of the Android Operating System. Because the App is not declared as a "Accessibility Tool" under Google Play's specific assistive categories, the Android system may, at its sole discretion, terminate Android Accessibility Service to manage device resources.
Opnico Ltd shall not be held liable for any security breaches, undetected Threats, or damages incurred during periods when the Service is inactive. This includes, but is not limited to, instances where:
The Android operating system (OS) deactivates the Opnico SafeSurf Accessibility Service or restricts background processes.
The Device is operating in Android Advanced Protection Mode (AAPM) or similar high-security configurations that may limit the App's monitoring capabilities.
The User has not granted or has revoked necessary permissions.
User Responsibility: It is the User's responsibility to ensure the Opnico SafeSurf accessibility service remains active for continuous protection.
By user: You may terminate this agreement at any time by ceasing all use of the Service, cancelling any active Subscriptions through Your platform provider, and deleting the App from Your Device.
By company: We may terminate or suspend Your Account and access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if You breach these Terms.
Survival: All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, intellectual property ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
To the fullest extent permitted by applicable law, You agree to defend, indemnify, and hold harmless Opnico Ltd, its affiliates, directors, officers, employees, partners, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, debt, and expenses (including, but not limited to, attorney's fees) arising from:
Your access to and use of the Service
Your violation of any provision of these Terms
Your violation of applicable law or third-party rights
This indemnification obligation shall not apply to the extent that any claim results from the Company's own negligence, willful misconduct, or breach of these Terms.
This clause does not limit rights under applicable consumer protection or data protection laws.
This obligation shall survive termination of these Terms to the extent permitted by law.
Severability: If any provision of these Terms is held to be unenforceable, invalid, or illegal by a court of competent jurisdiction, such provision will be modified and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions of these Terms will continue in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Opnico Ltd.
Communication and language policy: To ensure clarity and accuracy in all communications, Our team provides support and processes legal inquiries exclusively in English. We reserve the right to respond only to correspondence written in English. Any notices or inquiries sent in other languages may not be processed or acknowledged.
General and corporate inquiries: For questions regarding these Terms, corporate partnerships, or strategic inquiries, please contact Us at opnico.com@gmail.com. Our team strive to respond to all non-urgent inquiries within 3–5 business days.
Payments (store transactions & refunds): Payments made via the Apple App Store or Google Play Store are managed by the respective platform providers. We are generally unable to provide support for these transactions directly. To resolve transaction-related issues, for billing support, or refund requests regarding in-app purchases, please contact Apple or Google directly via their official support channels, as We do not process these payments internally.

However, even the most advanced security tools cannot anticipate every risk on the Internet. We provide this service on an "as-is" basis, meaning we cannot guarantee complete immunity from cyber threats and are not liable for any damages or losses that may occur despite your use of the app.
To stay ahead of bad actors, our threat database is updated every single hour. Because we analyze risks in real-time against our global intelligence infrastructure, a stable Internet connection is required on your device to perform a successful online lookup.
To ensure the best experience for everyone and maintain system stability, a technical rate limit of 60 requests per minute (3600 per hour) applies to all users.
